Welcome to Legacy MVMT LLC, doing business as Legacy and Legacy MVMT (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website www.legacymvmt.com (the “Site”), mobile application ABC Trainerize (Legacy) (the “App”), and any other related products or services that link to these Terms (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, you may not access or use the Services. We may modify these Terms at any time. The “Last Updated” date will reflect the most recent update. Your continued use of the Services constitutes acceptance of any changes.

The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services. We recommend that you print a copy of these Legal Terms for your records.

1. OUR SERVICES
Our Services are provided for personal, non-commercial use only. You may not use the Services in jurisdictions where doing so violates local laws. Certain industry-specific laws (e.g., HIPAA, GLBA, FISMA) are not accounted for, and you must ensure compliance if applicable.

2. INTELLECTUAL PROPERTY RIGHTS

All content, software, trademarks, logos, and materials (“Content”) on the Services are owned by or licensed to us. You may access and download Content for personal, non-commercial use only.

You may not reproduce, distribute, modify, or exploit any Content without our prior written permission. All rights not expressly granted are reserved.

User Submissions and Contributions

  • Submissions: Any questions, comments, suggestions, or feedback you send us become our property and may be used commercially without compensation to you.

  • Contributions: Any content you post on the Services (text, images, videos, etc.) grants us a worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, distribute, and display such content. You retain ownership but waive moral rights and warrant that your Contributions do not violate any law or third-party rights.

We may remove or edit any Contributions at our discretion

 

3. USER REGISTRATION

Some Services may require registration. You agree to provide accurate information, keep your credentials secure, and are responsible for all activity under your account.

4. PRODUCTS

We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Services. However, we do not guarantee that the colors, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colors and details of the products. All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change.

 

5. PURCHASES AND PAYMENT

  • Prices, availability, and product details are subject to change.

  • Payments must be made in U.S. dollars using accepted payment methods (Visa, Mastercard, AmEx, Discover, PayPal).

  • All sales are final; no refunds will be issued unless otherwise specified.

  • We may refuse or cancel orders at our discretion.

We reserve the right to refuse any order placed through the Services. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

 

6. RETURN/REFUNDS POLICY

 

All sales are final and no refund will be issued

7. PROHIBITED ACTIVITIES

You may not:

  • Violate any laws or regulations.

  • Harass, abuse, or harm others.

  • Upload viruses, malware, or malicious content.

  • Collect personal data of other users for unsolicited use.

  • Use automated scripts or scraping tools without permission.

  • Reverse engineer or redistribute the Services.

  • Use the Services for commercial purposes without authorization.

Violation may result in suspension or termination of your account.
 

8. MOBILE APPLICATION LICENSE

You are granted a limited, non-transferable, revocable license to use the App on your devices in accordance with these Terms. You may not modify, distribute, or reverse-engineer the App.

App distributors (Apple App Store, Google Play) have their own terms which you must follow. Distributors are third-party beneficiaries of these Terms.

9. PRIVACY POLICY

Your use of the Services is governed by our Privacy Policy, incorporated herein by reference. By using the Services, you consent to the collection, use, and transfer of your data as described in the Privacy Policy.

10. TERMINATION

We may suspend or terminate your access at any time without notice for violations of these Terms or other reasons. You may not create a new account after termination without our permission.

11. LIMITATIONS OF LIABILITY

To the fullest extent permitted by law, we, our affiliates, and employees are not liable for indirect, incidental, or consequential damages arising from your use of the Services. Our total liability is limited to the lesser of (a) the amount you paid in the prior three months or (b) $120 USD.

12. INDEMNIFICATION

You agree to indemnify and hold harmless Legacy MVMT LLC and its affiliates, officers, and employees from any claims, damages, or expenses arising from your use of the Services or breach of these Terms.

13. USER DATA

You are responsible for the data you provide or transmit. We are not liable for data loss or corruption.

14. ELECTRONIC COMMUNICATIONS

By using our Services, you consent to electronic communications and signatures. Legal notices and agreements provided electronically are binding.

15. GOVERNING LAW

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

16. DISPUTE RESOLUTION

Informal Negotiations: Parties must attempt to resolve disputes through 30-day informal negotiation.
Arbitration: Disputes not resolved informally will be settled via binding arbitration under the International Commercial Arbitration Court rules, except for claims involving intellectual property or injunctive relief.

Class actions and representative claims are prohibited.

17. MISCELLANEOUS 

These Terms constitute the entire agreement. Failure to enforce rights is not a waiver. If any provision is invalid, the remaining provisions remain in effect.
